Constitution and By-Laws of NewPennDel

Article I-Name of Organization and Purpose

Section A.            Name:  NewPennDel

Section B.         Purpose of the Organization: To smooth the transition from a northern region to a southern region; to smooth the transition academically from high school to college and to maintain academic excellence; to assist in recruitment efforts; and to provide emotional and social support to current members.

 

Article II-Membership

Section A.         Members: Membership is open to any student who resides in Delaware, New Jersey, and Pennsylvania that is enrolled at Elizabeth City State University and who wishes to support the organization’s purposes.

Section B.         Requirements for Membership: Students enrolled must have a GPA of 2.0 and higher. Members must abide by the ECSU Code of Conduct.

 

Article III-Officers

Section A.         Title of Officers: The officers of NewPennDel shall be elected by the members and shall consist of the President, Vice President, Secretary, Treasurer, and Parliamentarian.

Section B.            Qualifications of Officers: All officers must maintain a GPA of at least a 3.3.

Section C.         Nomination and Election Procedures for Officers: The administrative terms of an office shall be from the fall semester through the end of the spring semester. The active members, who shall be nominated by the membership committee, shall elect the officers of the organization. No individual shall be nominated for more than one office. Elections will take place each year during the end of the spring semester.

Section D.         Procedure for Filling Vacancies: If a vacancy occurs in the office of the president, the vice president shall serve as an acting president for the remaining of the term of the office. Vacancies in any of the other offices shall be filled by a special election.

 

Article IV-Duties of Officers

Section A:            President:

                                                The responsibilities and duties of the president shall be to…
                       
                                    1.            serve as the primary spokesperson for “NewPennDel”.
                                    2.            coordinate the supervision and management of the affairs,
                                                            activities, business, and governance of “NewPennDel” in
                                                accordance with the by-laws.
                                    3.            preside over meetings.
                                    4.            vote only in case of a tie.
5.            serve as an ex-officio member of all committees except the membership committee.
                                    6.            provide student activities office with updated organization contact  
                                                            information.
                                    7.            attend or delegate another member to attend all students 
                                                            organization meetings.
                                    8.            appoint committee chairpersons subject to the approval of  
                                                            executive committee.

Section B.            Vice President:

It shall be the duty of the vice president to preside in the absence of the president and serve as chairperson of the program committee.
           
Section C.            Secretary:

                        It shall be the duty of the secretary to…

                                    1.  record the minutes of all meetings and distribute those minutes
                                         to each member and the advisors prior to the next meeting.
                                                2.  keep a file of the organization’s records.
                                                3.  maintain a current roster of membership.
                                    4.  issue notices of meetings and conduct the general
                                         correspondence of the organization.
                                    5.  prepare the agenda for all membership meetings.
                                    6.  receive, tabulate, and announce the results of all balloting
                                         and elections with the exception of officer elections.

 

 

Section D.            Treasurer:

                        It shall be the duty of the treasurer to…

                                    1.   receive, record, and deposit all revenues collected by the organization and                                                       pay funds on orders of the Executive Committee. All documentation must be                                                       signed by the President.
                                    2.   to administer the checking account, in accordance with the
                                                         executive committee decisions. Such administration shall
                                          include joint signatures of the treasurer and president in regards to any
                                          disbursement.
                                    3.   keep an itemized account of all receipts and expenditures and
                                          make reports as directed.

  1. serve as chairperson of the fundraising committee.

Section E.            Parliamentarian:

 

It shall be the duty of the parliamentarian to…

  1. maintain order at meetings.
  2. ensure the rules and regulations of the constitution are upheld.

 

Article V-Meetings

Section A.            Meetings: Weekly meetings shall be held during the fall and spring semesters. The time             of meetings will be determined based on class and activity schedule of members.

Section B.         Special Meetings: Special meetings will be called by the president or one of the advisors.

Section C.            Quorum: A quorum shall consist of one third of the current members.

 

Article VI- Ratification and Amending Process

Section A.         Ratification: This constitution has to be voted in favor of by two-thirds of the active members in order to be ratified.

Section B.         Amending process: These by-laws may be amended by a two-third (2/3) majority vote of the active members, provided a quorum is present. Such amendment or amendments shall have been submitted in writing to the Executive Committee. Within 30 days of the date received, it shall be submitted to the members in writing. The members shall have received the proposed amendment or amendments at least 14 days prior to the meeting.

 

Article VII-Standing Committees

Section A.         Standing Committees:  This organization will consist of the executive, program, fundraising, membership, academic, and advertising/hospitality committees.

Section B.            Duties of the Committees:

Executive Committee: shall consist of the organizations officers, chairpersons of each committee, and advisors. The committee will meet at least twice between regular meetings and the committee is responsible to uphold organization bylaws.

Program Committee: shall be responsible for developing and presenting suitable programs and activities for the enhancement of the organization.

Fundraising Committee: shall develop and implement fundraising events for “NewPennDel”. Funds will be used to increase revenue of the organization.NewPennDel will oversee daily operations for the Water Hole.

Membership Committee: will be responsible for recruiting new members on campus as well as keeping record of the attendance of the active members.

Academic Committee: will be responsible for monitoring the academic progress of all members of the organization and provide access to tutoring services, if needed. This committee is also responsible for providing internship possibilities to all the members.

Advertising/Hospitality Committee: will be responsible for promoting the events and activities of the organization. This committee is responsible for planning functions. This committee is also responsible for planning all decorations, food, and/or accessories that will be used.

 

Article VIII-Parliamentarian Procedures

Section A.            General Rules:

  1. NewPennDel does not discriminate in terms of race, sex, gender, sexuality, and/or religious beliefs.
  2. All members are expected to show respect for others.
  3. Meetings are held weekly.  An active member is considered a person who attends eighty-five percent of the meetings a semester.
  4. Members of the board or active members can have a position on committees.
  5. All members are expected to pay twenty-five dollars in dues per semester to help with the daily functions of the organization
  6. All members are expected to be members of the Pre-Alumni Association; membership dues are five dollars.

 

Section B.            **New Members:

-New freshmen are expected to maintain an overall GPA of 3.5 for the         
  first year.
-Sophomores are expected to maintain an overall GPA of 3.4 for the
  second year.
-Juniors and seniors are expected to maintain an overall GPA of 3.3 until
  graduation.
**Anyone who has a GPA that is less than the expected GPA for their class year       
   are still members as long as they maintain a GPA of 2.0. However, whoever
   does not meet the requirements are considered inactive members until the GPA 
   reaches the desired level. Members who do not maintain the required GPA are  
   expected to get tutoring when needed from other members or elsewhere.

Section C.            Voting procedures:

                                                            -Ten members are needed at the meeting for a vote to take place.
                        -Two thirds of the members present are needed to pass a
  resolution.

Section D.            Impeachment or Dismissal from Organization:

Impeachment procedures:

  1. A petition for removal of an officer shall be signed by at least

five members of the organization and submitted in writing to the president. If the president is the subject of the petition, it shall be presented to the executive committee.

  1. The president or vice president shall solicit relevant evidence

from all parties concerned, and call a meeting of the executive committee to consider the matter within fifteen days following receipt of the petition.

  1. The executive committee shall forward the petition, with or

without recommendations, to a meeting of the general membership that is held within thirty (30) days following the executive committee’s consideration of the petition.

  1. At the meeting of the general membership, an opportunity shall

be made available to all interested parties to present any additional relevant evidence. A two-thirds majority vote of members present, provided there is a quorum, is necessary for the removal of the officer.

                                                            Causes for Dismissal:

                                                                        -theft
                                                                        -disorderly conduct/ negative publicity
                                                                        -conspiracy
                                                                        -bashing
                                                                        -fighting
                                                Process:

-Sufficient evidence must be presented to members for      
  consideration.
-Members are to pass a vote on innocence or guilt based on voting
  procedures.

Consequences:

 

-If found guilty, suspension or expulsion of the guilty party is   
 decided by a vote from the members.

 

Article IX-Advisors

Section A:         Selection: There shall be two advisors who shall be selected each year by the membership.

Section B:            Duties: The responsibilities of the advisors shall be to…

                                                            1.  maintain an awareness of the activities and programs sponsored    
                                                                 by the student organization.
                                                            2.  meet on a regular basis with the leader of the student
                                                                             organization to discuss upcoming meetings, long range plans,
                                                                 goals, and problems of the organization.
3.  attend regular meetings and executive board meetings as often as their 
                                         schedules allow.
4.  assist in the orientation of new officers.
5.  explain and clarify campus policies and procedures that apply to
                                         the organization.
6.  maintain contact with the Office of Student Activities.
7.  provide direction in the area of parliamentary procedure,
                                         meeting facilitation, group building, goal setting, and program
                                         planning.
8.  assist organization’s treasurer in monitoring expenditures,
                                         fundraising activities, and corporate sponsorship to maintain
                                         an accurate and up-to-date account ledger.
9.  inform the organization’s members of those factors that constitute
                                         unacceptable behaviors on the part of the organization’s members,
                                         and the possible consequences of said behaviors.
